The following Terms of Service (“Terms”) are a binding legal agreement between you and Budify that define and govern your usage of the websites and other offerings that Budify (collectively, the “Budify Platform”) provides. When used in these Terms, “Budify,” “we,” “us,” or “our” refers to the Budify entity, with whom you are contracting.
The Budify Platform offers an online venue that enables users to publish, offer, search for, and reserve experiences. Users who publish, offer, and sell experiences are “Buddies” while users who search for, book, use, and purchase experiences are “Guests.” Buddies, or hosts, offer events (“Experiences”). You must create a username (and an account) to access and use features of the Budify Platform, and must keep your account information accurate. As the provider of the Budify Platform, Budify does not own, control, offer or manage any experiences. Budify is not a party to the contracts concluded directly between Hosts and Guests, nor is Budify a real estate broker, insurer, or a certified tourism site. Budify is not acting as an agent in any capacity for any user, except as a reservation and payment collector.
If you Host, you are responsible for understanding and complying with all laws, rules, regulations and contracts with third parties that apply to your experiences.
Host Terms
1.1 Host. As a Buddy, you will be able to share and sell your own unique experiences with various guests utilizing our platform. You will have the freedom to select the experience details, price, availability, location, and rules.
1.2 Contracting with Guests. You will be entering into a direct contract with the guest, once you accept a reservation or receive a reservation confirmation through Budify. Once this takes place, you are responsible for delivering your Budify experience, following the details, terms, price, and conditions illustrated in your Listing. At the same time, you are agreeing to pay a 10% service fee (and applicable taxes) for each reservation that takes place. Budify will be deducting the 10% service fee, and any taxes applicable, for each transaction from you unless we and you have previously agreed to a different contract. All terms, rules, and conditions you include in an additional contract with the guest must be consistent with Budify’s terms and conditions, policies, and your published experience details.
1.3 Independence of Hosts. You will remain as an independent individual or entity, under your relationship with Budify. You will not become an employee, agent, joint venturer, or partner of
Budify. Budify will act as a payment collection agent. Budify does not direct or control your experience, and you agree that you have complete discretion whether and when to provide Budify services, and at what price and on what terms to offer them.
1.4 Fees. Budify will charge a 10% fee from the reservations you confirm. Such fees are non- refundable. Budify has the right to change the service fee at any time, but will notify its members before the change becomes effective. Such changes will not affect reservations made before the fee change date. If you disagree with a fee change in the future, you have the right to terminate your account and agreement.
1.5 Content Management. Your experience page must include complete, correct, and updated information about the specific experience, such as price, inclusions, location, availability, and cautions. Any problems caused by your uncaution of managing your experience page and its contents will not be supported or resolved by Budify.
1.6 Responsibilities. You are responsible for complying with any relevant laws, regulations, and rules to your experience. You are agreeing to utilize any personal data related to your users, only when necessary prior to and during the experience. You are unallowed to utilize any user personal information, once the experience ends. You must respect all users and guests, regardless of ethnicity, race, nationality, gender, sex, education, appearance, and more.
1.7 Budify. You may not directly charge any extra fees against your users for your personal benefit, outside the platform. You are not allowed to ask users to use third-party platforms, pay outside of Budify, or provide any irrelevant personal information.
1.8 Reservation Modifications. Reservation modifications can take place when the Buddy and user both agree on the specific circumstances.
1.9 Your Assumption of Risk. By accepting a reservation, you are expressing your full understanding and judgement of any risks and dangers that may be involved within. By accepting a reservation, you are expressing your willingness to take such risks based on your own choice.
User Terms
2.1 Reservation. When you reserve a Budify experience, you are agreeing to pay all charges related to the reservation, such as the experience price, taxes, and any additional fees that occur but are not included under the experience price, depending on the experience. You are confirming that your personal information are correct and up to date, and you are responsible for notifying your Buddy on any medical, physical, financial, religious, linguistic, or cultural conditions that may affect the experience. You are not allowed to bring any unauthorized guests to the experience unless they have officially reserved the experience through Budify as well.
2.2 Cancellations, Travel Issues, and Refunds. If you cancel a reservation later than 48 hours prior to the experience, you may not be able to receive a refund. However, any cancellation that takes earlier than 48 hours prior to the experience will lead to a full refund.
2.3 Reservation Modifications. Reservation modifications can take place when the Buddy and user both agree on the specific circumstances.
2.4 Your Responsibilities. When making a reservation, you are agreeing to remain respectful and truthful throughout the experience. You are also agreeing to abide by any relevant laws and regulations. If you are participating with a minor related to you, you are responsible for supervising the minor.
2.5 Your Assumption of Risk. By reserving a Budify experience, you are expressing your full understanding and judgment of any risks and dangers that may be involved within. It is your responsibility to thoroughly review any inherent risks that may occur during a specific experience, and by reserving an experience, you are expressing your willingness to take such risks based on your own choice.
